Welcome to Kaspers Web and SEO. By engaging our services or using our website, you agree to the following Terms and Conditions. Please read them carefully.

1. Definitions

  • “Company,” “we,” “us,” and “our” refer to Kaspers Web and SEO, a trading name of Kaspers OÜ, a company registered in Estonia under registration number 17122115, with its registered office at Sepapaja tn 6, Lasnamäe linnaosa, Tallinn, Harju maakond, 15551, Estonia.
  • “Client,” “you,” and “your” refer to the individual or business engaging our services.
  • “Services” encompass website design, SEO, hosting, maintenance, and related add-ons as described on our website.

2. Scope of Services

  • We provide services as outlined in our packages on the Pricing page. Customizations or additional work outside the agreed scope will incur extra charges.
  • Hosting and maintenance are provided on a subscription basis and billed monthly or annually.
  • The number of design revisions is limited to two (2) rounds per project. Additional revisions will be charged at €75/hour.

3. Payment Terms

  • A deposit of 50% is required to commence work. The remaining balance is due upon project completion unless otherwise agreed.
  • Hosting and maintenance fees are billed upfront. Late payments may result in service suspension.
  • Unpaid invoices 7 days past the invoice due date will incur a late fee of 1.5% per week.
  • All payments are non-refundable once work has commenced.

4. Client Responsibilities

  • You agree to promptly provide all necessary information, materials, and feedback to ensure the project’s completion.
  • You are responsible for ensuring that any content provided (e.g., text, images) complies with copyright laws.
  • You are responsible for purchasing and maintaining domain names unless otherwise agreed upon.
  • If you provide third-party assets (e.g., fonts, images, plugins), you confirm you have the proper licenses and rights to use them.

5. Intellectual Property

  • Upon full payment, complete website ownership will be transferred to you.
  • We reserve the right to use the completed project in our portfolio and marketing materials unless explicitly requested otherwise.

6. Hosting Services

  • Hosting is provided on a managed basis and includes the features outlined in our packages.
  • We are not liable for downtime caused by third-party providers or circumstances beyond our control.
  • Hosting can be cancelled with 30 days written notice. Refunds for unused periods will not be provided.

7. Maintenance Services

  • Maintenance services cover updates and edits as outlined in our packages. They do not include major redesigns or new features, as they will likely take longer than the time specified in the package.
  • Maintenance plans must be active to receive continued support and updates.

8. SEO Services

  • SEO is a long-term strategy, and results may vary depending on competition, industry, and other factors.
  • We do not guarantee specific search engine rankings but commit to implementing best practices to improve performance.

9. Cancellation and Termination

  • Service Requests: You may cancel any requested service within 48 hours of submission without penalty. After 48 hours, cancellation may result in charges for any work completed.
  • Annual Plans: If you have paid for a year in advance, you may switch to monthly payments within the first 2 weeks of the agreement. After this period, no refunds will be provided for unused months.
  • Ongoing Projects: If you cancel a project after work has commenced, you are responsible for payment for all completed work up to the date of cancellation.
  • Notice Period: Hosting and maintenance services require 30 days written notice to terminate. Unless otherwise agreed, refunds will not be provided for unused portions of prepaid services.

10. Limitation of Liability

  • We are not responsible for any direct, indirect, incidental, or consequential damages arising from the use of our services.
  • Our liability is limited to the amount paid for the specific service.

11. Force Majeure

  • We shall not be held liable for failure to fulfil obligations due to causes beyond our control, including but not limited to natural disasters, third-party service failures, cyberattacks, government actions, or other force majeure events.

12. GDPR Compliance

  • Your privacy is important to us. We comply with the General Data Protection Regulation (GDPR) to ensure your data is handled responsibly and transparently.
  • Data Collection and Use: We collect only the data necessary to provide our services, such as your name, email address, and business details. Your data will not be shared with third parties unless required to fulfil our services or comply with legal obligations.

13. Governing Law

  • These Terms and Conditions are governed by and construed in accordance with the laws of Estonia. Any disputes arising from these terms shall be resolved under the exclusive jurisdiction of the Estonian courts.

14. Modifications

  • We reserve the right to update these Terms and Conditions at any time. Changes will be effective upon posting to our website. Continued use of our services constitutes acceptance of the modified terms. We will notify any existing customers of policy changes.
